TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions govern the use of services provided by Kay’s Logistics JA (“the Company”). By engaging the Company’s services, the Customer agrees to be bound by the following terms.

1. DEFINITIONS

  • “Company” refers to Kay’s Logistics JA.

  • “Customer” refers to any individual or entity utilizing the Company’s services.

  • “Shipment” refers to any package, parcel, freight, or goods handled by the Company.

    2. ACCEPTANCE OF TERMS

    By tendering goods for shipment or utilizing any service provided by the Company, the Customer acknowledges and agrees to these Terms and Conditions in full.

3. SERVICES

The Company provides international freight forwarding, package consolidation, customs facilitation assistance, and local delivery services within Jamaica. The Company acts solely as a freight forwarder and not as a common carrier.

4. RATES AND CHARGES

4.1 All charges are calculated based on actual weight, dimensional weight, or agreed pricing structure.

4.2 The Company reserves the right to adjust rates without prior notice.

4.3 Additional charges may apply for:

  • Oversized or overweight shipments

  • Special handling

  • Storage beyond the permitted free period

  • Customs duties, taxes, or government-imposed fees

4.4 All duties, customs charges, and taxes are the sole responsibility of the Customer.

5. PAYMENT TERMS

5.1 Full payment must be received prior to release or delivery of any shipment.

5.2 The Company reserves the right to withhold goods until all outstanding balances are settled.

5.3 Late payments may result in additional storage fees.

6. PROHIBITED AND RESTRICTED ITEMS

The Customer shall not ship items prohibited under Jamaican law or international regulations, including but not limited to:

  • Firearms, ammunition, and explosives

  • Illegal narcotics or controlled substances

  • Flammable or hazardous materials

  • Counterfeit goods

  • Any item restricted by customs authorities

The Company reserves the right to refuse, confiscate, or report prohibited shipments to relevant authorities without liability.

7. LIABILITY LIMITATION

7.1 The Company shall not be liable for loss, damage, or delay caused by:

  • Acts of God

  • Natural disasters

  • Airline or shipping line delays

  • Customs inspections or seizures

  • Government action

  • Incorrect information provided by the Customer

7.2 All shipments are transported at the Customer’s own risk unless insurance coverage is purchased.

7.3 Claims for loss or damage must be submitted in writing within twenty-four (24) hours of receipt of goods.

9. DELIVERY TERMS

Delivery timelines are estimates only and are not guaranteed. The Company shall not be liable for delays beyond its reasonable control.

10. CUSTOMER WARRANTIES

The Customer warrants that:

  • All information provided is accurate and complete.

  • The goods comply with all applicable laws.

  • The goods are properly packaged for transport.

11. INDEMNIFICATION

The Customer agrees to indemnify and hold harmless the Company against any claims, penalties, losses, or legal actions arising from the shipment of prohibited or improperly declared goods.

12. GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of Jamaica.

13. AMENDMENTS

The Company reserves the right to amend these Terms at any time. Updated terms shall become effective immediately upon publication.
